Terms and Conditions.

1 · Scope

These General Terms and Conditions (Terms) apply to all services provided by magic places AG, Josef-Müller-Weg 6, 6210 Sursee, Switzerland (hereinafter "magic places®", "we") to guests and customers (hereinafter "you"). They apply to the booking and delivery of the intro session, the sessions, the programs, the membership, and supplementary services such as CEO mentoring and coaching.

Deviating terms apply only if we have confirmed them in writing. A separate Austrian legal entity will operate the future Salzburg location; separate terms apply to its services.

2 · Our offering

magic places® operates centres for regeneration and vitality. Our services serve relaxation, regeneration and personal well-being.

Important: Our services are not medical treatment and do not replace medical examination or advice. We do not make diagnoses and give no promises of healing. Measurement values we collect serve your orientation and your personal self-assessment, not the determination of a state of health. If you have health complaints, are pregnant or take medication, please clarify your participation with your doctor beforehand.

3 · Conclusion of contract

The presentation of our offerings on this website is not a binding offer but an invitation to book. With your booking, you make a binding offer. The contract is concluded as soon as we confirm the booking, and at the latest when the appointment takes place.

For bookings via our online booking system, you will receive a confirmation by email. Please check your details before submitting; we will gladly correct obvious input errors after consultation.

4 · Intro session

The intro session is the entry point to magic places®. It lasts around two hours, takes place in a single visit and includes arriving, experiencing the applications, a measurement and a personal conversation. It can be booked once per person.

Together with you, the intro session determines which program or membership fits your goal. It creates no obligation to book any further offering.

5 · Programs and membership

• Boost program: eight weeks with two appointments per week, with a measurement at the beginning and at the end.
• Focus Impact: 12 to 16 weeks with two appointments per week, with personal guidance and supplementary services.
• Regeneration Flow Membership: one fixed appointment per week, billed monthly.

Appointments within a program are planned together. Appointments not attended are forfeited unless they were cancelled in time in accordance with section 7. The membership continues on a monthly basis until it is terminated in compliance with the agreed notice period.

Satisfaction guarantee: After four weeks, you can end an ongoing program or membership. We bill services already received according to actual use.

6 · Prices and payment

The prices we quote to you in a personal conversation or in the booking confirmation apply. Prices are in Swiss francs (CHF) and include statutory value added tax where applicable.

Invoices are payable within 30 days of the invoice date without deduction, unless otherwise agreed. For programs and membership, payment in advance or in instalments can be agreed. If you fall into arrears, the statutory provisions of the Swiss Code of Obligations apply.

7 · Cancellation and rescheduling

For every appointment, we reserve the room, technology and personal attention exclusively for you. Please therefore cancel early if you cannot come:

• Cancellation up to 24 hours before the appointment: free of charge, we will gladly reschedule.
• Cancellation later than 24 hours before the appointment, or no-show: the appointment counts as used and will be charged.

In the case of illness or another reason for absence through no fault of your own, we will find a fair solution. If we have to cancel an appointment, for example due to a technical failure, we will offer you a replacement appointment; no further claims exist.

8 · Right of withdrawal for guests from the EEA

If you book remotely as a consumer residing in the EEA, you may, under the law of your country of residence, be entitled to a 14-day right of withdrawal. If you wish us to begin providing the service before this period expires, the right of withdrawal lapses once the service has been fully provided. An informal message to hello@magic-places.com is sufficient for a withdrawal.

9 · Your cooperation and the house rules

To make your visit a success, we ask the following of you:

• Inform us before your first application of any health circumstances that are material to your participation.
• Follow our team's instructions on using the applications and equipment.
• Arrive on time. If you arrive late, the session is shortened accordingly.
• Be considerate of other guests. Our rooms are places of quiet.
• Do not use the applications under the influence of alcohol or narcotics.

We may exclude guests from use who repeatedly violate the house rules or significantly disrupt operations. In this case, we will refund services already paid for but not used on a pro rata basis.

10 · Liability

We are liable for damage arising from injury to life, body or health, and for damage we have caused intentionally or through gross negligence, in accordance with the statutory provisions. In all other respects, our liability is limited to the foreseeable damage typical of this type of contract, to the extent permitted by law.

We assume no liability for valuables you bring with you, unless we are at fault. Lockers are available.

11 · Vouchers

Vouchers are transferable to other persons unless otherwise noted. They cannot be redeemed for cash. The statutory limitation period applies.

12 · Photo and audio recordings

Recordings in our premises are only permitted with our consent and with the agreement of the persons depicted. If we ourselves make recordings for our communications, we obtain your consent beforehand; you can withdraw it at any time.

13 · Data protection

How we process your data is set out in our Privacy Policy.

14 · Changes to these Terms

We may amend these Terms, for example when our offering or the legal situation changes. For ongoing programs and memberships, we will inform you in advance; if you do not object within 30 days, the new version is deemed accepted.

15 · Applicable law and place of jurisdiction

The contractual relationship is governed exclusively by Swiss law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

The place of jurisdiction is Sursee, Canton of Lucerne, Switzerland. Mandatory places of jurisdiction in favour of consumers remain reserved.

Should any provision of these Terms be invalid, the remainder of the contract remains valid. The invalid provision shall be replaced by a provision that comes closest to its economic purpose.
